Not long ago in these pages, a column asserted that humor is misplaced in the courtroom and proscribed for attorneys: “Don’t Be Funny: Litigation is no laughing matter to your clients” (November 2015). There is some truth in the observations: Misguided humor can be dangerous in the courtroom, especially inappropriate “jokes.”Worst of all are jokes that—purposefully or inadvertently—target either the vulnerable or the victimized, or that somehow denigrate the gravity and importance of the proceeding itself (especially to the litigants). The column provides several illustrations of bad courtroom humor—jokes that clearly miss their marks. These misguided attempts at humor are toxic and can have horrible and unintended consequences in litigation, saying far more about the speaker than about the subject of the humor. But the genre of comedy is much broader than bad jokes, and the edge of a sense of humor can be a useful litigation … [Read more...] about Don’t underestimate the value of comedy in the courtroom
Law firm ads that show attorneys towering over skyscrapers and offering legal advice to space aliens obviously aren’t meant to be taken seriously. But New York’s attorney general isn’t finding them at all amusing, reports Portfolio magazine on its website. In a brief filed yesterday in response to a July decision by a federal judge invalidating new state restrictions on law firm advertising, attorney general Andrew Cuomo contends that the First Amendment protects only “truthful, factual, nonmisleading information relevant to the attorney’s services,” the article notes.Although the U.S. Supreme Court held in 1977 that law firm advertising is permitted under the First Amendment, that ruling apparently isn’t intended to extend to lawyers leaping tall buildings at a single bound, according to Cuomo. “It has never held that puffery, dramatizations, unverifiable statements of opinion, slogans, or promises, absurd portrayals, extreme use of … [Read more...] about Funny Lawyer Ads No Joke in N.Y.
Bad jokes and poor judgment can be disastrous in the courtroom.Salon has a list of eight horrible courtroom jokes, leading with the knock-knock joke told by George Zimmerman’s lawyer, Don West, during opening statements. Here is West’s joke: “Knock-knock. Who’s there? George Zimmerman. George Zimmerman who? All right, good. You’re on the jury.”The Salon writer, Fordham law professor Geoffrey Sant, says the joke insulted jurors who were selected because they didn’t know much about Zimmerman, who was later acquitted in the death of Trayvon Martin. But Sant says the worst joke in legal history occurred during the first oral argument of Roe v. Wade before the U.S. Supreme Court. Defending Texas’ abortion restrictions, lawyer Jay Floyd opened with an aside about the two lawyers arguing against him, who were female. “It’s an old joke,” Floyd began, “but when a man argues against two beautiful ladies like this, they are … [Read more...] about Was ‘beautiful ladies’ comment in Roe v. Do looks count? Judge Alex Kozinski of the San Francisco-based 9th U.S. Circuit Court of Appeals would like to think so, according to a press release with a tongue-in-cheek nod to his win in an unusual contest buried in the last paragraph. The press release announces the swearing-in ceremony for Kozinski’s appointment to become chief judge of the circuit.Kozinski was prominently featured on the Underneath Their Robes blog when he wrote a letter bemoaning his lack of inclusion in its Superhotties of the Federal Judiciary contest.“Sure, John Roberts and Jeff Sutton are young and extremely handsome, but so what?” he wrote. “I have it on very good authority that discerning females and gay men find graying, pudgy, middle-aged men with an accent close to Gov. Schwarzenegger’s almost totally irresistible. So I nominate myself.”Kozinski’s lobbying worked—he later won the contest, the National Law Journal reports in this profile.Kozinski continues … [Read more...] about ‘Hottie’ Judge Kozinski Continues Joke in Press Release
Last summer, comedian Robert Kaseberg filed a copyright infringement suit against Conan O’Brien, among others, alleging that O’Brien incorporated four jokes written by Kaseberg in the opening monologues of his television show “Conan.” According to the complaint, Kaseberg published each of the jokes – all of which were based on then-current events and news stories – on his personal blog and Twitter feed on various dates between January and June, 2015, only to have O’Brien feature the same jokes in his monologues on the same respective dates.Copyright lawsuits involving the infringement of jokes are surprisingly rare. As a result, lawsuits such as Kaseberg’s raise interesting – and largely unsettled – issues about the application of copyright law to comedy routines and jokes. For instance, one issue likely to arise in lawsuits involving “one-liners” about current events is whether the allegedly infringing … [Read more...] about Copyright Is Nothing To Joke About
A lawyer for West Publishing didn’t see the humor when a federal judge hearing a motion to set aside a nearly $5.2 million defamation verdict tried to lighten the proceedings.New York lawyer James Rittinger is asking the judge to overturn or reduce the award to two law professors who said they were defamed when West identified them as the authors of a pocket part that was written by a first-year lawyer. The Legal Intelligencer covered the arguments. The senior federal judge, John Fullam, “is known for an especially dry wit and a deadpan delivery,” the Intelligencer says. When Rittinger said the professors didn’t have “a single case” to back up one of their arguments, Fullam asked, “What about married cases?” When Rittinger objected to the size of a punitive award, Fullam asked, “You think it should be increased?”Rittinger explained that he got the joke when the judge tried to explain the first question, according to the … [Read more...] about West Lawyer Is Unimpressed with Judge’s Jokes in Hearing on $5.2M Pocket Part Verdict

In a series of changes that CLAT 2015 is going to introduce, the latest one seems to be making the online exam also in Hindi. Reportedly, the Implementation Committee for Common Law Admission Test (CLAT) met on Saturday and made a proposal that the question paper should also be in Hindi. However, the proposal can only materialize when the Core Committee, which consists of Vice Chancellors of all 16 participating National Law Universities, confirms such a move. Question paper in Hindi is also an idea that could give a massive boost to exam takers, whose numbers have been growing year by year. Moreover, since it will be Dr. RMLNLU, Lucknow that will be organizing the CLAT 2015, it is also being expected the numbers of students taking CLAT in Uttar Pradesh will go up.Reportedly, out of the eight new centres, three will be in Uttar Pradesh.
