Many readers will be aware that Sports Shorts has been tracking the development of esports over the last 18 months, particularly its journey towards possible inclusion within the Olympic Movement. In September 2016, we looked at the relatively recent ‘explosion’ of esports in Europe and the US, the emergence of new governing bodies, and some of the regulatory issues beginning to rear their heads. In October 2016, we examined the growing trend for ‘traditional’ sports to invest in esports (from NBA teams, to European football teams, and most recently NFL team owners). Then, in April this year, following the announcement of esports as an official medal sport at the 2022 Asian Games, we covered the debate surrounding the move to include esports more fully within the Olympic Movement, a destination which, in August, appeared to be one step closer when Tony Estanguet (co-president of the Paris Olympic bid committee confirmed that he would be discussing … [Read more...] about IOC Brings Esports To Pyeongchang And Confirms Esports “Could” Be A Sport: What Does This Mean For The Sporting Landscape As We Know It?
Regulation-weary employers excitedly anticipated the new Trump Administration – and its promises that ranged from repealing the Affordable Care Act to appointing a friendly U.S. Supreme Court Justice to abolishing the fiduciary and overtime regulations. But, change often comes slowly in government, and employer expectations have been frustratingly delayed by some unexpected upsets on Capitol Hill. Apart from the last-minute decision to withdraw the GOP healthcare bill, here’s a quick update on two key Trump nominees.Secretary of LaborThe ill-fated nomination of Andy Puzder for Secretary of Labor crumbled under rumors of economic conflicts and domestic abuse. Trump called Alexander Acosta off the bench and Acosta testified last week before a Senate committee, although his testimony was overshadowed by healthcare and Russian spying.Acosta brings a mix of government, prosecutorial and NLRB experience to the post. During his Senate hearing, Acosta kept his employment policy … [Read more...] about Update on Trump’s Line-Up for DOL and Supreme Court
Settlement requires Volkswagen to offer to buy back older vehicles, and spend $225 million to mitigate NOx pollution. Volkswagen will also repair newer vehicles to comply with the standards to which they were certifiedIn a second partial settlement announced today by the U.S. Environmental Protection Agency (EPA), the Department of Justice (DOJ), and the State of California, automakers Volkswagen AG, Audi AG, Porsche AG and related entities (collectively referred to as Volkswagen), have agreed to recall 83,000 model year 2009 through 2016 3.0 liter diesel vehicles sold or leased in the U.S. that are alleged to be equipped with “defeat devices” to cheat emissions tests, in violation of the Clean Air Act and California law. For the older vehicles, Volkswagen is required to offer to buy back the vehicles or terminate leases, and must also offer an emissions modification to substantially reduce emissions if one is proposed by Volkswagen and approved by regulators. An expensive sports car owned by a Florida criminal defense attorney went on a wild ride Friday after he left it parked outside the garage of his home with the keys inside it.Stolen a little after midnight, the 2014 Audi R8 was recovered at nearly 11 p.m. the same day in the parking lot of a convenience store. Meanwhile, it had clocked over 200 mph while being driven down Interstate 75, suspect Michael Bancs, 47, told authorities once he was arrested, a police report says.Bancs initially denied having been behind the wheel when approached by Manatee County sheriff’s deputies who had spotted the distinctive vehicle, which has a manufacturer’s suggested retail price of more than $100,000. However, a clerk at the store said Bancs had been revving the engine, the Daytona Beach News-Journal reports. Bancs, who had been standing near the sports car, was swaying and seemingly intoxicated, the police report said.Around 5:30 p.m. a Bradenton policeman also had spotted the stolen … [Read more...] about Lawyer’s $100K sports car goes on a wild ride after he leaves the keys in the vehicle
Governance in sport has been a hot topic in the UK in recent months, with the release of Sport England and UK Sport’s “Code for Sports Governance” on 31 October 2016, followed by the inevitable media scrutiny on some of UK’s sports governance juggernauts, including (in particular) the FA and, most recently, the revelations and allegations in relation to British Cycling. The UK has sought to lead the way by setting the ‘gold standard’ for sports governance. The hope was, and remains, that the UK Code will be looked upon internationally as a model for good governance. Unsurprisingly, given the high-profile scandals in sports governing bodies in recent years, the topic has indeed been in the spotlight on the international stage, including at an EU policy level. On 2 February 2017, the European Parliament (“EP”) adopted a Resolution “on an integrated approach to Sport Policy: good governance, accessibility and … [Read more...] about Should the EU Introduce its own Governance Code for Sport?
Reuters reports that Sports Direct International Plc, Britain’s largest sporting goods company with about 700 stores throughout Europe, is discussing a bid for Eastern Outfitters LLC (“Eastern Outfitters”), the parent of Bob’s Stores and Eastern Mountain Sports (“EMS”).Versa Capital Management LLC (“Versa”) is the owner of Eastern Outfitters. Last April, Vestis Retail Group LLC, the former holding company for Bob’s, EMS, and Sports Chalet, filed for Chapter 11 bankruptcy protection. Versa acquired Bob’s and EMS through the bankruptcy. However, after lower than expected holiday sales and problems with financing, many landlords of the almost 90 operating EMS and Bob’s stores report that January and February rents remain unpaid. EMS and Bob’s Stores, along with Golfsmith and Sports Authority, were among the major sporting goods retailers that filed for bankruptcy protection in 2016.According to Reuters, industry … [Read more...] about Possible Chapter 22 for British EMS Brand – Sports Direct Eying EMS After Poor Holiday Sales
On Thursday 8 June 2017 the British people will go to the polls to determine who will lead their country for the next four years and who will (almost definitely) oversee the nation’s exit from the European Union. It’s been almost a year since Britain voted for Brexit (to be precise, on Thursday, it will have been 350 days) and in that time much has been written about the possible, probable or preposterous effects of Brexit on the UK’s sporting industry and economy and its various stakeholders.Legitimate questions have been asked and are still (for the most part) unanswered. For example, will The FA or the Premier League be successful in lobbying the new government that footballers should be exempt from post-Brexit immigration controls (this author would unequivocally argue ‘yes’) and, further, can The FA and the Premier League agree on the scope and extent of those exemptions? Or, will the UK’s position as the … [Read more...] about General Election 2017: What Does Your Vote Mean For Your Sport?
Confidential leaks and allegations of espionage have abounded in recent months in both sporting and political contexts, whether that be the furore surrounding alleged hacking relating to the US presidential election or the shadowy Fancy Bears gaining access to the databases of both the World Anti-Doping Agency and the United States Anti-Doping Agency. And now allegations of espionage or, at the very least, “loose lips” have arisen in the context of Rugby Union. Whilst Sale Sharks’ sacking of Tom Arscott for allegedly leaking information to his elder brother Luke does not, admittedly, have the same geo-political ramifications as the incidents referenced above, it does shine a spotlight on the obligations of confidentiality that an employee owes to his employer, the categories of “business information” that commonly arise and the measures that employers can take to protect information provided to employees during the course of their employment. Sacking … [Read more...] about Anti-Doping: Leaked Line-Out Codes And Duties Of Confidentiality
